Key definitions:
Distance contract: a consumer contract concluded under the distance selling system for the provision of products or services, concluded without the simultaneous physical presence of the parties, where the parties exclusively use means that allow communication between absent parties to conclude the contract.
Product: any movable item offered and intended for sale on the website, which forms the subject of the contract.
Buyer: any natural or legal person, or organization without legal personality, to whom the Seller sells a product through the website.
Consumer: a natural person acting outside their independent occupation and economic activity for purposes other than those related to their occupation or economic activity.
Availability of the General Terms and Conditions:
The Seller publishes the current General Terms and Conditions on its website or sends them electronically to the Buyer.
Contents of the General Terms and Conditions:
These General Terms and Conditions contain the rights and obligations of the Buyer using the electronic commerce services provided by the Seller and the terms of agreement between the contracting parties. They apply to orders placed on www.gin.maximumweb.hu and through other channels. These terms qualify as general contractual terms under Act CVIII of 2001 on electronic commerce services and certain services related to the information society, Section 5 (1), and comply with the provisions of Government Decree 45/2014 (II. 26.) on detailed rules of contracts between consumers and businesses.
The Terms and Conditions apply to all sales and services ordered by the Buyer via the Seller’s online store or other ordering methods. The Buyer must accept these terms by ticking the checkbox on the website or confirming by electronic mail to use the Seller’s services. Upon acceptance, a contract is formed between Seller and Buyer under these terms.
If the Seller publishes or sends these Terms and Conditions to the Buyer before payment, and the Buyer pays without returning acceptance, it will be deemed accepted.
Scope of the General Terms and Conditions:
These General Terms and Conditions come into effect on April 3, 2023, which coincides with their publication date on the website. They apply to all Buyers and purchases from that date forward and remain in effect until revoked.
Before submitting the order, the Buyer declares that they are familiar with, have read, understood, acknowledged, and explicitly accept the currently effective General Terms and Conditions. By submitting the order, the Buyer acknowledges that the currently effective General Terms and Conditions form an inseparable part of the contract between the parties.
The Seller reserves the right to amend these General Terms and Conditions. In the event of amendments, the terms in effect at the time of order submission shall apply.
Purchase process and contract formation:
The contract is concluded electronically when the Buyer orders the product, sends the order, and the Seller confirms acceptance (expressly accepting the Buyer’s offer) to the Buyer’s provided email address, complying with data protection regulations.
The Seller reserves the right to withdraw from the contract even after sending confirmation if performance cannot be expected for reasons beyond its control (e.g., product no longer available, substantial lack of stock, force majeure, illness, etc.). In case of withdrawal, the Seller must settle accounts with the Buyer if money or goods were exchanged.
Products distributed by the Seller are presented on www.gin.maximumweb.hu, and the products available in the webshop constitute the subject of the contract between Seller and Buyer. Clicking the “Purchase” button provides access to individual products and detailed information about them. Decorative elements visible in photos are not part of the product unless explicitly highlighted in the product description. The Seller does not accept liability for any errors or incorrect data.
Buyers can select the quantity of products to order and place products in the shopping cart via the “Add to cart” button. The cart contents can be viewed by clicking on the “Cart” icon and label in the top right corner, showing selected products and their quantities. The Buyer can continue browsing the site after exiting the cart.
At any time during shopping, the Buyer may view and modify the cart contents. The quantity can be modified by entering a new number or clicking + or – in the “Quantity” column, then pressing the “Update cart” button. Products can be removed by setting quantity to zero or clicking the “X” next to the product.
On the order form, the Buyer’s details (name, address, email, phone) must be entered. If billing and shipping addresses differ, the “Ship to a different address?” box must be checked, and the shipping details provided.
Buyers can write notes related to the order in the designated box.
After providing data, the Buyer selects shipping and payment methods.
Acceptance of these General Terms and Conditions occurs by ticking the corresponding checkbox.
If all details are correct, the order is submitted by pressing the “Submit order” button.
Information on the website does not constitute an offer from the Seller to conclude a contract. Orders subject to these Terms and Conditions constitute offers by the Buyer, and the contract arises when the Seller accepts the Buyer’s offer.
By pressing the “Submit order” button, the Buyer explicitly acknowledges that the offer has been made and that, upon confirmation by the Seller, the Buyer is obligated to pay.
The order’s receipt is acknowledged automatically by email. Should it be necessary, the Seller will contact the Buyer by phone or email.
The contract is concluded when the Seller declares acceptance of the Buyer’s order. If the Seller confirms the order by email (expressly accepting the Buyer’s offer), the contract comes into effect. If confirmation is not received within 48 hours, the Buyer is released from the obligation to purchase.
The Buyer accepts that contracts concluded in this way are not in writing and are governed by Hungarian law.
The contract is in Hungarian. The webshop stores orders electronically and does not register contracts otherwise, so retrieval later is not possible.
Customer Service:
The Seller responds to Buyers’ questions related to orders at the contact details specified in these General Terms and Conditions, Monday to Friday between 8:00 and 16:00.
Selling Price:
Prices shown in the online store are valid consumer prices in Hungarian Forints and include the general sales tax. Shipping costs are not included and are always borne by the Buyer unless otherwise stated on the website. The Seller reserves the right to change prices. After confirmation of the order by the Seller, the payable amount does not change. Errors or misprints causing significant price deviations do not bind the Seller. Incorrect orders will be reconfirmed by phone or email before dispatch. The Seller is not liable for damages from incorrect pricing.
Possibility to correct data entry errors:
The Buyer can continuously correct or delete data during the order. After submitting the order, changes can be requested via the Seller’s contact details. The Seller is not responsible for damages resulting from erroneous or inaccurate data entry by the Buyer. Incorrect email addresses or full mailboxes may hinder confirmation emails. The Seller may attempt further contact by other means.
Payment Terms:
Payment for products ordered in the webshop can be made by cash on delivery or bank card via the SimplePay system.
Cash on delivery: The Buyer must pay in cash at delivery.
Bank card payment (SimplePay): Payment is processed through OTP Bank’s SimplePay system. The Buyer is required to enter card data (name, number, expiry date, CVC code) to initiate payment. SimplePay’s general terms apply. The Buyer accepts data transfer to OTP Mobil Kft as a data processor. The Seller does not handle or store card data.
Shipping Conditions:
Products ordered are delivered via GLS logistics. Shipping costs are always borne by the Buyer. Delivery is made to the address provided by the Buyer. Upon receipt, the Buyer must check product integrity. Claims are only accepted in writing via courier reports. Uncollected products will only be shipped again after payment of all costs.
Delivery Time:
Delivery to the Buyer is within 5 business days from the order date. Higher demand may lead to delays.
Information and Liability concerning products:
The Seller is not liable for damages or health problems caused by improper use of products. No liability is assumed for individual allergic reactions. The Seller recommends Buyers check product composition and avoid purchasing if sensitive. No contracts are made with minors; the Buyer guarantees to be over 18.
Data Protection:
The Seller processes personal data in strict compliance with applicable laws, respecting the principles of legality, fairness, transparency, purpose limitation, data minimization, accuracy, and limited storage. Technical and organizational measures are taken to secure data consistent with the EU GDPR (Regulation (EU) 2016/679). The Data Management Policy is available on the Seller’s website.
Right of Withdrawal:
For contracts concluded off-premises or at a distance, the Consumer has 14 calendar days from product receipt to withdraw without reason. The right may be exercised in writing or by a clear declaration within this period. The Seller must refund payments within 14 days of withdrawal notification. The Buyer bears return shipping costs. Specific exceptions apply, including perishable goods or sealed hygienic products.
Warranty and Guarantees:
The Seller provides statutory warranty and guarantees for product defects. The Buyer can claim warranty rights for defects not known or expected at purchase. Detailed warranty procedures follow Hungarian regulation 19/2014 (IV.29). Claims can be made personally or in writing with proof of purchase. The Seller commits to handling claims promptly.
Warranty Rights:
The Buyer may demand repair, replacement, price reduction, or contract withdrawal for defective performance per civil law. Deadlines and conditions for claims are specified, including a notification window within two months of discovering defects and limitation periods.
Product Warranty:
The Buyer can claim product warranty for items defective at delivery. Warranty claims must be made within two years of product release to the market. The manufacturer/distributor is liable unless exceptions apply (e.g., defects not recognizable at market release).
Statutory Warranty:
Mandatory statutory warranty obligations do not apply to the Seller’s products.
Notification of Warranty Claims:
Claims under warranty require proof of purchase and can be made in person or writing. Records of claims and resolutions are kept for 3 years. The Seller must inform the Buyer about alternative dispute resolution and authorities to contact.
Complaint Handling:
The Seller reviews all complaints and responds promptly, including written documentation of handling steps. Electronic complaints must be acknowledged within 30 days. The Seller maintains complaint records for 3 years.
Arbitration Board, Consumer Protection, Court Enforcement:
Buyers are informed about the possibility to initiate dispute resolution with the relevant Arbitration Board or court if dissatisfied with the Seller’s response. Contact details for Arbitration Boards are provided, including the Budapest Arbitration Board.
Online Dispute Resolution:
The European Commission provides an online platform for disputes related to online purchases, allowing Buyers to seek amicable settlement without court procedures.
Miscellaneous Provisions:
Buyers are assumed to have technical and legal knowledge to use electronic commerce sites. Liability exclusions apply for technical errors. Invalid provisions do not affect the validity of the remaining terms. Hungarian Civil Code and relevant legislation apply.
Relevant Legislation:
The contract is governed by Hungarian laws including but not limited to Consumer Protection Act 1997, Electronic Commerce Act 2001, Civil Code 2013, Warranty regulations, and others.
